The institution-based view of IPR protection in the United States indicates that it was interests that turned the United States from an IPR violator to an IPR champion. In other words, the turn was not cultural, political or voluntary but interest-driven. Both the US government and the US firms were at first reluctant to honor and respect IPR and just felt comfortable to continually pirate British publications for American book publishers, newspapers, and magazines. That was because Great Britain, the superpower at that time, was a net producer of IP and the United States, the emerging economy of the day, was a net consumer of IP. As the United States became a superpower later with rapid economic development and more American publishers starting to publish and market more writers’ s books overseas, the United States became the victim of pirates by other countries. To protect their own interests, indigenous authors, inventors, and firms within the United States pushed the American government which also saw its people’s interests in IPR to pass the Chace Act of 1891. With this, the United States started to offer IPR protection in the country to foreign authors and inventors. Hence, the United States “voluntarily” turned from being an IPR violator to an IPR champion.

A study of the IPR history in the United States offers a better understanding of today’s US-China IPR debate which can be viewed as a reappearance of the IPR conflict between Great Britain and the United States in the past. As far as IPR is concerned, Great Britain to America is like America to China. The United States is today’s superpower and China is an emerging economy at present. The focus of the US-China IPR debate is that the United States hopes to protect the American interests of IPR, whereas China wishes to take advantage of the piracies at a lower cost to achieve rapid economic development. When it comes to a conflict of interests, IPR debate between the United States and China turns out to be not only a legal problem, but also an economic problem and even a political problem. However, the lessons from this episode of IPR history in the United States help inform that it takes a time-consuming process for the development of IPR in every country. Both the United States and China need to be patient. Therefore, only when the United States continues to push China to reinforce the management of IPR and gives more time to China at the same time and on the other hand China develops its economy and improves its IPR systems can their debate become fruitful.

The institution-based view makes great sense to predict when China will become serious in protecting IPR. As the second largest economy in the world, China has achieved world-shocking development in all aspects. And it is now trying to transform its labor-intensive industries into technology-intensive industries. To enhance the transformation, China will definitely promote IPR to the level of national strategy, improve its capability of independent innovation, perfect IPR systems, strengthen the cultivation of IPR professionals, and broaden IPR cooperation with other countries, especially the United States. During this process, China will certainly achieve greater development and have more technologies and intellectual property worthwhile for other countries to pirate. However, this is not to justify the act of pirating. Pirating should always be a shame but it is just an indispensable process for every emerging economy to develop throughout the history of IPR in the world. The present China is actually already quite powerful, so it should speed up the process of IPR with sufficient determination to abide by the rules of the game. But what China lacks now is just what the United States once needed, namely, inadequately powerful economy, ample intellectual property and adequate motivation. All in all, when China also becomes an IP producer as well as a victim of IPR pirates, it will become really serious in protecting IPR.
