    On the Utilitarian ground, the driver might compute as follows. Killing one person by veering the train off is better than letting five people die. After all, what matters is the balance of social utility. Therefore, this computation is an easy job--five minus one is four! The four people saved by his veering off the train would continue to contribute to the society. However, Utilitarian might take into account the overall influences of this case on the society. The driver might take look around to figure out if any one else is watching what is going on. If he were sure that no one knows that it is their veering the train off that makes the death of the one person on the alternate track, they would just veer the train off. Otherwise, they would take into account possible panic and uncertainty spurred by this fact spread in the society. That is, people just don’t know when they would be killed in the name of social utility. Taking possible panic into account, they might give up veering off the train to the alternate track. On the deontologist ground, the driver might ask if the rule “save 5 people by killing one” can be universalized. Because killing intentionally is a murder, the driver might think that a murder cannot be justified by any consequence it yields. And it is impossible to universalize murder. Otherwise, humanity would be eliminated. What’s more, the driver might think that killing 5 people to save one is not respecting the five people, since they are used as means to produce some consequences. Thus, on the deontologist ground, the driver should always not veer off the train regardless whether their behaviors are being spot by someone.

On my ground, I won’t veer the train off, either. It is not my fault that the brake has failed. If I veered off the train, I am killing people intentionally and that is morally wrong regardless whether it would produce greater social utility or whether murder would be universalized. However, am I responsible for the wretched five people killed in this accident? Truly, it is a great pity to see them being killed by the train. However, I do not owe them anything. I have tried my best to avoid killing anyone with the current tools and conditions. But my ability is too limited that I fail to save the five guys. Someone might condemn that I have should have done something—it is within my capacity to veer off the train, saying that if I give up veering off the train, I am just killing them. I don’t think so. Yes, physically and technically I am able to do veer of the train. But morally, I can’t do that. It is the malfunction of the brake that kills the five people, not me. It is reasonable to consider the death of the five people caused by an accident caused by irresistible forces. Just as the eruption of volcano would kill people and people won’t condemn those who fail to save their fellows, those who morally fail to save the five people should not be condemned, either.
